US finalized restrictions on investments in artificial intelligence and semiconductors in China

The United States has finalized regulations restricting investments in key technology sectors in China, including artificial intelligence, due to national security concerns, according to an announcement from the Treasury Department.

These restrictions will prohibit U.S. citizens, permanent residents, and U.S.-based companies from engaging in transactions involving technologies such as AI, semiconductors, and quantum computing, as stated in a Treasury press release on Monday.

Additionally, U.S. investors will be required to notify the Treasury about investments in certain less advanced technologies that could pose a threat to U.S. national security.

The curbs, which are due to take effect on January 2, will ensure “US investment is not exploited to advance the development of key technologies by those who may use them to threaten our national security,” said Paul Rosen, the assistant secretary of the Treasury for Investment Security.

“US investments, including the intangible benefits like managerial assistance and access to investment and talent networks that often accompany such capital flows, must not be used to help countries of concern develop their military, intelligence, and cyber capabilities,” Rosen said.

The restrictions follow President Joe Biden’s signing of an executive order last year aimed at curbing investments in semiconductors, microelectronics, quantum computing, and specific artificial intelligence technologies.

At that time, Biden cautioned that U.S. investments could support adversaries in developing sensitive technologies vital for their military, intelligence, surveillance, or cyber capabilities.
